What is the H-1B lottery and what are the odds?
The H-1B cap-subject lottery selects petitions randomly from all registrations. For FY2026, USCIS received ~470,000 registrations for 85,000 slots (65,000 regular cap + 20,000 US master's cap). Lottery odds were approximately 28% for the bachelor's cap and an additional 11% for the master's cap.
Is H-1B premium processing worth it?
Premium processing ($2,805) guarantees USCIS will act within 15 business days β either approving, issuing an RFE, or denying. It does not guarantee approval. It's worth it if your start date is time-sensitive or you need early certainty.
Can I transfer my H-1B to a new employer?
Yes. H-1B portability (AC21) allows you to change employers after your I-485 has been pending for 180+ days. Even without AC21, you can transfer an approved H-1B to a new employer with a new petition β no new lottery required.
What happens if my H-1B petition receives an RFE?
A Request for Evidence (RFE) means USCIS needs more information. You typically have 87 days to respond. Your attorney will gather documentation to demonstrate your specialty occupation qualifies. Most RFEs, when well-responded to, result in approval.
What is cap-exempt H-1B?
Cap-exempt H-1Bs don't go through the lottery. They're filed by certain nonprofits, universities, and government research organisations. If you work for or will work at a cap-exempt organisation, you can file an H-1B at any time with no lottery.
